Report copyright infringement
If you are the copyright owner or authorized to act for the owner, your written notice must include:
- Your physical or electronic signature.
- Identification of the copyrighted work claimed to be infringed, or a representative list if multiple works at one site are covered.
- Identification of the material claimed to infringe and information reasonably sufficient for us to locate it, such as the specific Sublyst listing URL and affected photo or text.
- Information reasonably sufficient to contact you, including your address, telephone number and, if available, email address.
- A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act for the owner of the exclusive right allegedly infringed.
Consider whether permission or an exception such as fair use applies before submitting. We may request missing information. When we remove or disable access in response to a notice, we take reasonable steps to promptly notify the person who supplied the material.
Counter-notices
If your material was removed or disabled because of mistake or misidentification, you may send our agent a written counter-notice containing:
- Your physical or electronic signature.
- Identification of the removed or disabled material and the location where it appeared before removal or disabling.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, address and telephone number; a statement consenting to the jurisdiction of the Federal District Court for the judicial district where your address is located (or, if outside the United States, any judicial district in which Sublyst may be found); and a statement that you will accept service of process from the original complainant or that person’s agent.
We promptly forward a valid counter-notice, including its required contact details, to the original complainant and inform them that we will restore the material in ten business days. We restore access no sooner than ten and no later than fourteen business days after receiving the counter-notice, unless our agent first receives notice that the complainant has filed an action seeking a court order restraining the disputed infringement. Separate, independently applicable listing rules may still require restricting the material.
Repeat infringement and accurate submissions
Our policy is to terminate accounts of repeat infringers in appropriate circumstances. We consider the relevant facts, including valid counter-notices and reversals; submitting a complaint does not by itself establish infringement. We accommodate and do not interfere with standard technical measures within the meaning of 17 U.S.C. § 512(i).
Knowingly making a material misrepresentation in a notice or counter-notice can result in liability under 17 U.S.C. § 512(f). Seek legal advice if you are unsure about your rights or the consequences of a submission.
We use and share copyright correspondence as described in our privacy notice. Include the information required for the process, but do not send passwords, identity documents or unrelated sensitive information.
Content covered by this process
This process applies to allegedly infringing listing photos, text, public Host introductions, campus images and other content hosted by Sublyst. Ordinary disagreements about a rating or listing belong in support unless they also present a copyright claim. The notice and counter-notice requirements, agent contact information and retention procedures below remain applicable.
